Based on practical years of experience with a lot of clients and investors, and recognizing the fact that most people are not aware of the legal tones with ownership of Land in Nigeria.  I dim it fit to enlighten  people on this matter.   I will therefore highlight these five types of legal ownership for the purpose of informing Nigerians and non Nigerians on this position of the law because I believe that information is power. The Supreme Court in the case of ELEGUSHI V OSENI (2005) 14 NWLR (PT 945) AT 348 aptly stated the five types of legal land ownership in Nigeria and they are as follows: 1, By traditional evidence. 2. Image
1. Never Buy #Lands From Natives (Even The Baales) Many innocent #investors have been swindled off their hard-earned monies in the process. Never buy #property from the natives directly because they are not the #government. They do not #excise, #gazette or #exclude. It is a huge risk, entrusting your monies with them. Instead #buy property from duly registered and credible #firms. If you have to buy from the natives, you have to come equipped with a powerful #lawyer who has solid experience in #RealEstate matters. 2. Always Opt For Physical Inspection. As much as Ibeju-Lekki is been touted as the next Real Estate Gold, you must be mindful of the #LOCATION of the land you are about to purchase. For example, my team and I discovered that some estate agents have been selling lands in #Epe, promoting them as Ibeju.A Nigerian man resident in #Canada was sold land in Orisa on the pretext that it was #IbejuLekki. It was when he wanted to commence construction, his contractor told...

Differences between Right of Occupancy (R of O) and Certificate of Occupancy (C of O)

Image
Right of occupancy (R Of O) is just an offer while a (C Of O) certificate of occupancy is certified right of your ownership of the said land.  R of O is a weaker title to land and vulnerable while C of O is a superior title and secured.  R of O could be revoked without compensation while C of O is compensated for. Hence, it's very important to perfect your land title to C of O after an offer of R of O is given to you. That's why most land buyers are very concerned on the title as a C of O always attracts a higher value.  When given an offer of R of O, a premium sum is attached to the offer to be paid for perfection to C of O. For clarifications, please visit relevant land authorities.  The right of occupancy is usually granted by a Local Government Authority as defined as a customary right of occupancy.  The definition is in Section 6 of the land use Act, a customary right of occupancy includes the right of a person or commun...

Image
THE ADVANTAGES & DISADVANTAGES OF  INVESTING IN REAL ESTATE. Investing in real estate is not for the faint of heart. There are many variables that make real estate investing  significantly profitable. On the other hand, the same variables may cost investors far more than what  they bargained for. Before investing in real estate, understand the advantages and disadvantages of such  a venture. You may purchase the property for much less than its value, repair or update it, and resell or flip it at a much higher...

SMALL BUDGET HOME BUILDING

HOW TO BUILD CHEAP HOUSES IN NIGERIA Although , many people determine the type of accommodation they want and how they want it delivered, not many feel satisfied when it comes to financing that option. Some people due to class competition may go higher in procuring their materials and even choose the best architect, the best surveyor and the best property supervisor in terms of cost from London for a building he wants to construct in a remote area in Yobe State of Nigeria.  All these are mainly because the developer has got the where withal to get himself whatever he wants. In the same vein, somebody in California could engage an architect from Nigeria and a property supervisor all from Nigeria, to get what he wants. The implication of all that is that most times, those who have enough money do not consider cost when they want to do things. This is most peculiar to Nigeria (Africa) where most of the men/women did not suffer to make their money.  But whether one ...
